Privacy policy

We care about the security of your data. We value your trust in us and we are committed to protecting and responsibly processing your personal data.

This privacy policy informs you about the main purposes of personal data collection and processing, explains how long personal data is stored, to whom it is provided, what rights data subjects have and where to apply for their implementation or other issues related to the processing of personal data.

Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 of the European Union (the ‘Regulation’), the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the protection of personal data.

1. General provisions

1.1. This policy sets out:

1.1.1. What personal data we collect and process and how much it relates to our relationship with you as a customer;

1.1.2. Where we get the data from;

1.1.3. How we treat the data;

1.1.4. How we store the data;

1.1.5. To whom we transfer/disclose the data;

1.1.6. How we deal with your data protection rights;

1.1.7. How we comply with data protection regulations.

1.2. All personal data is collected and processed in accordance with the requirements for the processing of personal data established by the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other legal acts related to the protection of personal data, and from 25 October 2020 – the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data).

2. Terms and definitions

Data controller means farmer Povilas Balevičius (‘Jorus.lt’), farm registration number 6545026, VAT number LT100003003216, e-mail:info@jorus.lt.

Data processormeans service provider who provides services (performs works) and processes your data on behalf of the farmer Povilas Balevičius as a data controller. Data processors shall have the right to process personal data only in accordance with our instructions and only to the extent necessary for the proper performance of the obligations set out in the contract.

Data subjectmeans a customer, i.e. a natural person who has purchased or ordered goods from the farmer Povilas Balevičius.

Personal datameans any information relating to a natural person, i.e. a data subject whose identity is known or can be established directly or indirectly by means of such data as a personal number, one or more personal, physical, physiological, psychological, economic, cultural or social featured.

Processing of personal datameans any operation carried out in respect of personal data: collection, recording, storage, classification, grouping, combining, modification (addition or correction), provision, publication, use, logical and/or arithmetic operations, search, dissemination, destruction or other action or several of actions.

Cookies mean short textual information that websites transfer to users’ computers or other devices. Depending on the browser, this information is stored either in small individual files or in a single file of cookies stored by different websites. Cookies are used by most advanced websites in Lithuania and abroad. Cookies can only be transferred if this option is available in your device settings.

3. What kind of personal data we collect

3.1. We process your personal data so that we can administer your purchase process on the e-shop www.jorus.lt. In order to register with www.jorus.lt and to create an account, you must provide the following information:

Full name;

Contact details (e-mail address).

In order to be able to purchase products on the e-shop www.jorus.lt, you must provide the following information:

Full name;

Contact details (phone number, e-mail address);

Delivery address;

Payment details (including but not limited to bank account number);

IP address;

Gender;

Purchase history;

Date of birth.

3.2. You decide what information to disclose. If you decide not to disclose your data, you do not get the opportunity to use some resources of the e-shopwww.jorus.ltUsers who choose not to subscribe free newsletters will not receive information about discounts and other important information. Having not provided the required personal data, you will not be able to complete the purchase process and we will not be able to sell you goods or provide services to you.

3.3. Jorus.lt obtains personal data from the data subjects. All this personal data is obtained only with the consent of the individual. By registering with the e-shop www.jorus.lt during the purchase process, you confirm that the personal data provided by you is accurate and correct, and you are at least 16 years old.

4. For what purposes we use your personal data

4.1. Your data may be used for the following purposes:

4.1.1 To supply products and provide services you want to purchase. We use the data to process your orders, resolve issues related to the supply or delivery of products and fulfil other contractual obligations or obligations established by the legal acts of the Republic of Lithuania and the EU;

4.1.2 To contact you if there is a change in the information about the delivery time of the goods or other information related to your order. These communications shall not be carried out for marketing purposes and cannot be waived.

4.2. Marketing. We will contact you from time to time by e-mail to provide information about product offers and additional products. You will also be able to specify whether you want to receive such information when ordering goods. In addition, each time you receive an e-mail, you will have the opportunity to indicate that you are no longer willing to receive our direct marketing offers.

4.3. We will only process your personal data having a legal basis for such processing. The legal basis will depend on the reasons why we collect your personal data and for what purposes we use it.

4.4. Only persons who are 16 years old or older may give a consent. Younger children need the consent of their parents or legal guardians.

4.5. When determining the appropriate storage period, we take into account the amount, nature and confidentiality of personal data, the purposes for which we process your personal data and whether we can achieve these purposes by other means. In addition, we must take into account the periods during which we may need to store personal data in order to fulfil our legal obligations (e.g. accounting documents, leasing agreements, etc.)

4.6. When we no longer need your personal data, we will securely delete it. We will also take into consideration whether and how we can minimize the personal data we use over time and whether we can make your personal data anonymous so that it is no longer associated with you or your identity, in which case we may use that information without further notice.

4.7. Other purposes of personal data collection:

4.7.1. In most cases, we will have to process your personal data in order to conclude a sales agreement with you;

4.7.2. We use the information you provide to us to ensure a smooth purchase process and to fulfil the orders;

4.7.3. The information you provide helps us to communicate smoothly with you and answer your questions;

4.7.4. At the time of ordering, the buyer’s data may be used for marketing purposes. The buyer may express his/her consent/disagreement with the use of his/her personal data for direct marketing purposes. The buyer can give his/her consent by ticking a statement ‘I agree that my personal data would be used for direct marketing purposes’ or disagree by not ticking it. With the consent of the buyer, the data controller sends a newsletter to the e-mail address specified by the customer. The data controller also allows you to unsubscribe the newsletter – you can do this by selecting the option ‘unsubscribe’ provided at the end of the newsletter);

4.7.5. Based on your data, we will contact you if you have abandoned your goods or found any problems regarding the completed orders;

4.7.6. We use the data provided for administrative or legal purposes – to resolve disputes or claims.

5. How and for how long we store your data

5.1. We will not store your data for longer than is necessary to achieve the purpose for which it is processed. When we no longer need your personal data, we will securely delete it. We will also take into consideration whether and how we can minimize the personal data we use over time and whether we can make your personal data anonymous so that it is no longer associated with you or your identity, in which case we may use that information without further notice.

5.2. In order to process your personal data, we have implemented appropriate organizational and technical security measures that help to protect personal data from accidental or unlawful destruction, alteration, disclosure, as well as from any other unlawful processing. The protection activities carried out by the farmer Povilas Balevičius also include the protection of staff, information, IT infrastructure, internal and public networks, as well as office buildings and technical equipment.

5.3. For the purposes of direct marketing, personal data may be processed for 10 years from the moment of obtaining consent to process personal data. When personal data is processed during advertising campaigns (direct marketing games, lotteries, giveaways), such personal data shall be processed for one year after the announcement of the results of the advertising campaign and the winners. Upon expiration of the data processing deadline, personal data shall be destroyed by an authorized employee of the company.

5.4. We seek not to store outdated or unnecessary information and to ensure that personal data and other customer information is kept up to date and correct.

6. To whom we provide your data

6.1.Data processorsWe provide your personal data to data processors who provide services to us (e.g. carry out accounting) and process your data on behalf of the farmer Povilas Balevičius as a data controller. Data processors shall have the right to process personal data only in accordance with our instructions and only to the extent necessary for the proper performance of the obligations set out by the order of the goods. When using subcontractor services, we take all necessary measures to ensure that our data processors have implemented appropriate organizational and technical security measures and maintain the confidentiality of personal data.

6.2. In response to requests of a court or public authorityWe provide your personal data in response to requests of a court or public authority, only to the extent necessary for the proper enforcement of applicable law or a court order / testimony.

7. Your rights

7.1. You shall have the right to:

7.1.1. Know (be informed) about the processing of your data (right to know);

7.1.2. Access your data and become familiar with how it is processed (right of access);

7.1.3. Request the correction or, depending on the purposes of the processing of personal data, to supplement incomplete personal data (right of correction);

7.1.4. Destroy your data or suspend the processing of your data (excluding storage) (right to destroy and right to be ‘forgotten’);

7.1.5. Require the data controller to restrict the processing of personal data in case of presence of a legitimate reason (right to restrict);

7.1.6. Not to consent to the processing of his/her personal data or to withdraw his/her consent to the processing of personal data at any time for one or more specific purposes, without prejudice to the lawfulness of the consented processing prior to the withdrawal of a consent.

7.2. The customer, in order to find out what his/her personal data is collected and used, must submit a request by e-mail: info@jorus.lt. Jorus.lt, having received a request from a data subject regarding the processing of his/her personal data, must provide an answer whether the personal data related to him/her is processed and provide the requested data to the data subject no later than within 30 calendar days from the data subject’s request, taking into account specific personal data handling circumstances. This period may be extended by two months, if necessary, depending on the complexity and number of requests.

At the request of the data subject, such data must be provided in writing.

7.3. In order to secure the data from illegal disclosure, Jorus.lt must verify the identity of the data subject upon receipt of a request from the data subject to provide data or exercise other rights.

8. Use of cookies

8.1. In order to improve your experience when visiting the website www.jorus.lt, we use cookies – small pieces of textual information that are automatically created while browsing the website and stored on your computer or other data terminal equipment. The information collected by cookies allows us to ensure that your browsing will be more convenient, provide you with attractive offers and learn more about the behaviour of our website users, analyse trends and improve both the website and the service.

8.2. You may choose whether you want to accept cookies. 8.3. The farmer Povilas Balevičius uses tracking software to track customer website-related habits and usage of the website. Based on the tracking results, we can create a more user-friendly website design and layout. This softwaredoes not collect any personal customer information.

8.4. We usually use the information collected through the use of cookies for the following purposes:

8.4.1. Use of functional cookies and provision of services. Cookies are very important for the operation of our website and electronic services, also, they ensure a smooth user experience. For example, if a user desires so, he/she does not need to enter his/her name, password, or other data each time he/she logs in.

8.4.2. Service development. By monitoring the use of cookies, we can improve the operation of our website and electronic services. We receive such information as which sections of our website are the most popular, from which websites users come to our website and how much time they spend on our website.

8.5. The customer’s personal data shall not be stored by using cookies.

9. Amendments to the provisions of the privacy policy

9.1. The data controller shall have the right to independently amend or completely change the privacy policy by notifying about such amendment/changewww.jorus.lton the e-shop. Additions or changes to the privacy policy take effect from the moment of their publicationwww.jorus.lton the e-shop.

9.2. If after the amendments to the privacy policy the buyer continues to use the services provided by the e-shop, it is considered that the buyer agrees with the new version of the privacy policy.

9.3. The buyer may reject the new version of the privacy policy by submitting a written objection.

10. Final provisions

10.1. The data controller and the buyer, being the subject of personal data, base their cooperation on the principles of fairness and lawfulness.

10.2. All notifications related to the processing of personal data shall be submitted to the data controller by e-mail info@jorus.lt. Upon receipt of the buyer’s request, the data controller shall submit the response to the e-mail address specified by the Buyer.
